1. Introduction

RelyBytes S.r.l., as data controller, informs you under Article 13 of Regulation (EU) 2016/679 (GDPR) and the Italian Personal Data Protection Code (Legislative Decree 196/2003, the “Italian Privacy Code”) about how we process your personal data when you visit the relybytes.com website, send us a request through the forms of the site or write to us in the chat, by email or on WhatsApp. Our contact details are at the bottom of the page, in the “Data controller and contacts” section.

This policy covers the relybytes.com website only. The other sites and services you reach through our links, such as relyplatform.app, jobs.relyplatform.app, bytepills.it and status.relybytes.com, are not covered by this policy.

If you apply to work or collaborate with us through the form on the “Work with us” page, the data of your application is processed as described in the privacy notice for candidates and freelancers. For the cookies and other tools that are also present on that page, the “Cookies and other tracking tools” section of this policy applies.

Browsing the site does not mean giving consent, and we do not ask you to accept this policy: its purpose is to explain how we process your data. We ask for your consent only where the law requires it, that is for the statistics and marketing tools, through the cookie banner.

2. What data we process

Browsing data

Like every website, the servers that host relybytes.com receive and record the technical data of every request:

  • the IP address of your device
  • the date and time of the request
  • the page requested and the outcome of the request
  • the type of browser and operating system, as the browser reports them
  • the page you came from, if the browser reports it

Contact form

The contact form, on the Contact page and at the bottom of many other pages of the site, asks you for:

  • first name, last name and email address (required)
  • phone and company (optional, on the Contact page only)
  • the service you are interested in and your message (optional)

Together with the request we record the date and time it was sent and the language of the page you write from, which we use to send you the confirmation of receipt in Italian or in English.

Request for the availability of a profile

The “Request availability” button on the Talent as a Service page opens a form that asks you for:

  • the role you are looking for and your business email (required)
  • a message, for example about timing, technologies or seniority (optional)

We also record the date and time it was sent and the language of the page.

Chat

If you write to us in the chat of the site, we process the messages you send us and the data you decide to give us, such as your name or your email. The chat service also uses some technical data, described in the “Cookies and other tracking tools” section.

Email, phone, WhatsApp and Telegram

If you write to one of our email addresses, call us or write to us on WhatsApp, we process the data you give us, such as your name, your contact details and the content of the message. WhatsApp and Telegram, to which the links at the bottom of the pages lead, are third-party services: when you use them, your data is also processed by their providers, under their own policies.

Data collected with cookies and similar tools

If you accept them in the banner, the statistics and marketing tools described in the “Cookies and other tracking tools” section collect data about your browsing, such as the pages you visit, the page you came from, the type of device and the identifiers stored in your browser.

Data we do not ask for

No form asks you for special categories of data (Art. 9 GDPR), such as data concerning health, political opinions or religious beliefs, nor for data relating to criminal convictions and offences (Art. 10 GDPR). Please do not include them in your messages: if you do, we process them only to the extent strictly necessary to answer your request; otherwise we delete them.

Where the data of the forms goes

The site has no database of its own: the data you send with the forms passes through our server only to be forwarded to the mailbox of the team that answers you and to our contact archive. The requests of the contact form are also recorded in Rely Platform, the management platform developed and run by RelyBytes S.r.l., from which the automatic email confirming that we received your request is sent.

3. Why we process your data and on what legal basis

Answering your requests

Reading and handling the requests you send us through the forms, in the chat, by email, by phone or on WhatsApp, answering you and, if you ask us to, preparing a proposal for you. For requests sent with the contact form we also send you an automatic confirmation email.

Legal basis: performance of pre-contractual measures taken at your request (Art. 6(1)(b) GDPR).

Operation and security of the site

Running the site, showing it in the language of your browser, protecting it from abuse and cyber attacks, and finding and fixing technical problems, using the browsing data and the server logs.

Legal basis: legitimate interest in ensuring the operation and security of the site (Art. 6(1)(f) GDPR).

Visit statistics

Understanding which pages are visited and how to improve the site, with the tools of the “Statistics” category.

Legal basis: consent (Art. 6(1)(a) GDPR and Art. 122 of the Italian Privacy Code), which you give or refuse in the banner and can withdraw at any time.

Marketing and advertising

Measuring the effectiveness of our advertising campaigns, showing relevant ads on the platforms of our providers and identifying companies and people who may be interested in our services, with the tools of the “Marketing” category.

Legal basis: consent (Art. 6(1)(a) GDPR and Art. 122 of the Italian Privacy Code), which you give or refuse in the banner and can withdraw at any time.

Legal obligations and protection of our rights

Complying with obligations laid down by law or by the authorities and, where necessary, establishing, exercising or defending our rights, including in court.

Legal basis: compliance with a legal obligation (Art. 6(1)(c) GDPR) and legitimate interest in protecting our rights (Art. 6(1)(f) GDPR).

We do not use the data you send us with the forms or in the chat to send you newsletters or promotional communications.

Providing your data

  • The required fields of the forms are needed to handle your request: without them we cannot answer you (Art. 13(2)(e) GDPR). You can leave the optional fields empty.
  • Browsing data is necessary to visit the site.
  • Consent to the statistics and marketing tools is optional: if you refuse it, you can use the site without any limitation.

4. Who we share your data with

Your data may be disclosed to the following categories of recipients:

  • our staff authorized to process it (Art. 29 GDPR and Art. 2-quaterdecies of the Italian Privacy Code), who process it following our instructions;
  • IT service providers that process the data on our behalf as processors (Art. 28 GDPR), for email, hosting, contact management and the chat;
  • only if you give your consent, the providers of the statistics and marketing tools listed in the “Cookies and other tracking tools” section: Google, LinkedIn, Apollo.io and LiveIntent;
  • public authorities and the company's advisers, for example legal and tax advisers, where the law requires it or to protect our rights.

For the collection and transmission of data through the tools of LinkedIn and Apollo.io we are joint controllers with the provider (Art. 26 GDPR): for this stage you can exercise your rights against each of the two. For any later use the provider acts as an independent controller, under its own policy.

The matching of the visit to an email address, described in the “Cookies and other tracking tools” section, is carried out by Apollo.io and LiveIntent under their own responsibility, in accordance with their respective policies.

Google processes the data of Google Analytics on our behalf, as a processor.

We do not sell your data and we do not disseminate it.

5. Transfers outside the European Economic Area

The site is hosted on servers of OVH SAS in France, in Roubaix. For email, the contact archive and the chat we use Brevo, a service of Sendinblue SAS, a company based in France. Rely Platform is run by RelyBytes S.r.l., keeps its files on OVHcloud servers in Milan and is reached through the Cloudflare network.

Some providers of the statistics and marketing tools are based in the United States or transfer data there: Google Ireland Limited, which may transfer the data of Google Analytics and Google Tag Manager to Google LLC; LinkedIn Ireland Unlimited Company, which transfers it to LinkedIn Corporation; ZenLeads, Inc., the company behind Apollo.io, which is based in the United States. Google LLC, LinkedIn Corporation and ZenLeads, Inc. participate in the EU-U.S. Data Privacy Framework, which is the subject of the adequacy decision adopted by the European Commission on 10 July 2023 (Art. 45 GDPR); for Apollo.io the transfer also relies on the standard contractual clauses approved by the European Commission (Art. 46(2)(c) GDPR).

LiveIntent, Inc. is based in the United States. The matching of the visit to an email address that it carries out with Apollo.io takes place under the responsibility of the two companies, in accordance with their respective policies.

These transfers take place only if you accept the statistics or marketing tools.

For the other recipients, if your data is transferred outside the European Economic Area, the transfer takes place only with the safeguards provided for in Art. 44 et seq. GDPR.

6. How long we keep your data

We keep your data for the time strictly necessary for the purposes for which we collected it:

Requests that do not lead to a contract (forms, email, phone, WhatsApp)
24 months from the last contact, then we delete them; earlier, if you ask us to.
Requests that lead to a contract
For the whole duration of the relationship and, after it ends, for the time required by civil-law and tax obligations: 10 years (Art. 2220 of the Italian Civil Code).
Chat conversations
24 months from the last message.
Server logs
30 days.
Cookie choices
12 months; then the banner asks you again what to turn on.
Rely Platform visit statistics
24 months. They contain neither your IP address nor identifiers of your browser.
Google Analytics data
14 months, according to the setting of our Google Analytics property.
Cookies and identifiers of the other statistics and marketing tools
For the duration set by each provider, stated in its policy.

If we need a piece of data to establish, exercise or defend our rights, for example after a security incident or in the event of a dispute, we may keep it beyond these periods, for the time strictly necessary.

7. Your rights

As a data subject, you can exercise the following rights at any time:

Access (Art. 15 GDPR)
Obtain confirmation that we process data concerning you, access it and receive a copy.
Rectification (Art. 16 GDPR)
Request the correction of inaccurate data or the completion of incomplete data.
Erasure (Art. 17 GDPR)
Obtain the erasure of data concerning you, for example when it is no longer necessary or when you withdraw your consent.
Restriction (Art. 18 GDPR)
Request that the processing be restricted in certain circumstances, for example while we verify the accuracy of data you contest.
Portability (Art. 20 GDPR)
Receive, in a structured, commonly used and machine-readable format, the data you provided to us, when we process it by automated means on the basis of your consent or of pre-contractual measures, and transmit it to another controller.
Objection (Art. 21 GDPR)
Object at any time, on grounds relating to your particular situation, to processing based on our legitimate interest.
Withdrawal of consent (Art. 7(3) GDPR)
Withdraw at any time, as easily as you gave it, your consent to the statistics and marketing tools, from the “Cookie preferences” link at the bottom of every page. Withdrawal does not affect the lawfulness of the processing carried out before it.

If we rectify or erase your data or restrict its processing, we inform the recipients to whom we disclosed it, unless this proves impossible or involves disproportionate effort; if you ask, we tell you who they are (Art. 19 GDPR).

How to exercise your rights

You can exercise your rights by sending a written request to dpo@relybytes.com, specifying your request. If we have reasonable doubts about the identity of the person making the request, we may ask you for the information needed to confirm it (Art. 12(6) GDPR). We will reply within 30 days of the request; in complex cases this period may be extended by two months, in which case we will tell you within the first 30 days, giving the reasons (Art. 12(3) GDPR).

For the data that the providers of the marketing tools process as independent controllers, you can also contact them directly, at the contact details given in their respective policies.

Complaint

You also have the right to lodge a complaint with a supervisory authority under Art. 77 GDPR: in Italy, the Garante per la protezione dei dati personali (www.garanteprivacy.it), or the authority of the Member State where you habitually reside or work, or where the alleged infringement took place.

9. Automated decision-making and profiling

We do not take decisions based solely on automated processing, including profiling, which produce legal effects concerning you or similarly significantly affect you (Art. 22 GDPR).

If you accept the marketing tools, their providers may use your browsing data to build profiles, with which they measure campaigns and choose the ads to show you and, in the case of Apollo.io, identify companies and people who may be interested in our services.

10. Data security

We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, under Art. 32 GDPR.

11. Minors

The site is aimed at businesses, professionals and people looking for work. It is not intended for people under 18 and we do not knowingly collect their data: if we find out that we have received any, we delete it.

13. Changes to this policy

We may update this policy when the processing we carry out or the law changes. The date at the top shows the last change. If we add tools that require consent or change their purposes, the banner will ask for your consent again.
